مناسبات امنیت و آزادی در تضمین حریم خصوصی شهروندان در نظام حقوق اساسی ایران

چکیده
زمینه و هدف: امنیت عمومی و آزادی‌های فردی از بنیادی‌ترین ارزش‌های حقوق عمومی‌اند که در بسیاری از نظام‌های حقوقی در معرض تعارض و کشاکش قرار می‌گیرند. قانون اساسی جمهوری اسلامی ایران نیز در اصولی همچون ۹، ۲۴ و ۲۷ به این موضوع پرداخته است، اما به دلیل به‌کارگیری مفاهیم کلی، معیارهای مبهم و فقدان سازوکارهای اجرایی شفاف، زمینه سوءبرداشت‌ها و محدودسازی‌های نامتناسب فراهم شده است.
مواد و روش ­ها: این تحقیق از نوع نظری بوده و ‌روش تحقیق به‌صورت توصیفی- تحلیلی می‏باشد.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت­داری رعایت شده است.
یافته­ ها: اصلاحات پیشنهادی بر سه محور اصلی استوارند: پذیرش آزادی به‌عنوان قاعده و امنیت به‌عنوان استثنا؛ الزام به وجود قانون دقیق، شفاف و قابل پیش‌بینی برای هرگونه محدودیت؛ و ایجاد سازوکارهای نظارت و پاسخگویی مؤثر از طریق کنترل قضایی و پارلمانی، انتشار دلایل مکتوب و محدودسازی زمانی و موضوعی اقداماتاست.
نتیجه­: نتایج تحقیق نشان می‌دهد که چنین اصلاحاتی می‌تواند تعادل پایدار و سنجش‌پذیری میان آزادی و امنیت برقرار کرده، از امنیت محوری دائمی جلوگیری نماید و در عین حال امکان واکنش سریع در برابر تهدیدهای واقعی را حفظ کند. به این ترتیب، بازنگری اصول ۹، ۲۴ و ۲۷ نه‌تنها موجب تقویت حاکمیت قانون و اعتماد عمومی خواهد شد، بلکه جایگاه حقوق اساسی کشور را در انطباق با معیارهای پذیرفته‌شده بین‌المللی ارتقا خواهد داد.
