Jurisprudential Foundations of the Right to Family Life with a Human Rights Approach

Abstract
Background and Aim: The right to family life is considered the primary and main core of social rights; the purpose of this study is to explain the jurisprudential foundations of this right in Imami jurisprudence and the approach of human rights documents to it.
Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.
Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.
Findings: The findings of the present study show that the right to family life has certain characteristics, among which the emotional nature and the necessity of its implementation voluntarily and with free will are of great importance. This characteristic has caused the right to family life to have a dual form.
Conclusion: The right to family life and privacy, despite being recognized in international documents, jurisprudential sources, and domestic law, lacks traditional tools and guarantees of implementation at the implementation stage; this is why the aforementioned right has a legal form at the legislative and recognition stage, but has a moral form at the implementation stage.
