Jurisprudential foundations of the right to employment with an emphasis on human rights

Abstract
Background and Aim: The right to employment is one of the fundamental human rights that has also been identified in the literature of legal writers under the title of the right to work. The aim of the present study is to explain the jurisprudential foundations of the right to employment with regard to developments and its position in the international human rights environment.
Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.
Findings: The research findings show that despite the great importance of the right to employment, which is considered the main basis of welfare, the right to employment is considered a non-fundamental right in the normative hierarchy of international law.
Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed.
Conclusion: The jurisprudential foundations of the right to employment in Imami jurisprudence include the principle of equivalence, the principle of non-harm, and the principle of the Islamic state's intervention in employee-employer relations. These foundations are consistent with the examples of the right to employment in the human rights space, and no conflict is observed.
