Abstract
Background and Aim: The conflict of evidence and rulings is considered one of the most important issues in the science of principles. The rule of repelling evil by repelling evil is also one of the important rules in resolving conflict. The purpose of the present study is to explain the examples of the rule of repelling evil by repelling evil within the framework of criminal law and the foundations of human rights. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: The rule of repelling evil with evil is the basis for designing many articles of the Islamic Penal Code; this rule is used not only as a basis for legislation, but also in resolving conflicts between instances of criminal behavior in criminal law. On the other hand, human rights and their standards are also considered as criteria for identifying evil with corruption. Conclusion: The rules of self-defense, legal imperative, enforcement of the law, and emergency are considered to be concrete examples of the rule of preventing corruption by corrupting others in criminal law. Identifying the rule of preventing corruption by corrupting others greatly contributes to the process of implementing criminal law rules.
