Abstract
Background and Aim: The institution of government as the guardian of public order and ensuring the security of citizens has a special place in legal-political systems. The purpose of this study is to explain the obligations of governments in cases of epidemics within the framework of jurisprudence, Iranian law, and international documents. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Findings: The obligation of states to protect citizens in the event of an epidemic is accepted in all domestic legal systems as a principle of sovereignty, as well as in the customary norms of the international human rights system. Some of the basic principles and rules of Imami jurisprudence also require this obligation. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Conclusion: The commitment of states to protect individuals in cases of outbreaks of infectious diseases is guaranteed within the framework of Imami jurisprudence and Iranian domestic law; within the framework of international law, no specific responsibility is considered for the state in this regard; rather, reference should be made to the general and customary rules of the international responsibility system.
