This article attempts to examine the responsibility of content producers in cyberspace in accordance with human rights principles.</span> <strong><span>Materials and Methods</span></strong><strong><span>:</span></strong><span> This article uses a descriptive-analytical method and uses legal and scientific sources to write it.</span> <strong><span>Ethical Considerations:</span></strong><span> The principles and ethical considerations of writing practical research, including the principle of trustworthiness, have been considered by the authors of the article.</span> <strong><span>Findings</span></strong><strong><span>:</span></strong><span> </span><span>The responsibility of content producers in cyberspace requires considering the users of this space, including the government and governing institutions, the general public, and active content producers in this field. However, what is necessary is to create a kind of digital responsibility based on identifying and separating the destructive and threatening elements of public rights in cyberspace in order to provide a basis for the public to benefit from this right.</span> <strong><span>Conclusion</span><span>:</span></strong><span> </span><span>Resolving major problems in the field of content production based on digital responsibility can create rules for the government that will not deprive people of their right to the Internet and cyberspace under any pretext or threat from producers of undesirable content that goes against public will. Therefore, following the rule of law and prohibiting arbitrary decisions in the field of content production requires considering the economic and social rights of people in cyberspace.</span> <strong><span lang="FA">زمینه و هدف</span></strong><strong><span lang="FA">:</span></strong><span lang="FA"> </span><span lang="AR-SA">انتشار محتوا در فضای مجازی همواره با مخاطرات و تهدیداتی روبرو بوده یا اینکه خود محتوای ارائه شده مشکلات و آسیب</span><span lang="AR-SA">­</span><span lang="AR-SA">هایی نیز در پی داشته است. در این مقاله تلاش بر این است تا مسؤولیت تولیدکنندگان محتوا در فضای مجازی با توجه به اصول حقوق بشر مورد بررسی قرار گیرد</span><span lang="FA">.</span> <strong><span lang="FA">مواد و روش ­ها</span></strong><strong><span lang="FA">:</span></strong><span lang="FA"> </span><span lang="AR-SA">در مقاله حاضر از روش توصیفی-تحلیلی و با استفاده از منابع حقوقی و علمی برای نگارش آن استفاده شده است</span><span lang="FA">.</span> <strong><span lang="FA">ملاحظات اخلاقی</span></strong><strong><span lang="FA">:</span></strong><span lang="FA"> </span><span lang="AR-SA">اصول و ملاحظات اخلاقی نگارش تحقیق عملی از جمله اصل امانت‌داری مورد توجه نویسندگان مقاله بوده است</span><span lang="FA">.</span> <strong><span lang="FA">یافته­ ها</span></strong><strong><span lang="FA">:</span></strong><span lang="FA"> </span><span lang="AR-SA">مسؤولیت تولیدکنندگان محتوا در فضای مجازی نیازمند در نظر گرفتن استفاده‌کنندگان از این فضا از جمله دولت و نهادهای حاکمیتی، عامه مردم و تولیدکنندگان فعال محتوا در این عرصه است. اما آنچه ضرورت دارد ایجاد نوعی مسؤولیت پذیری دیجیتالی مبتنی­بر شناسایی و تفکیک عناصر مخرب و تهدیدکننده حقوق عامه در فضای مجازی است تا زمینه برای بهره‌مندی عمومی از این حق فراهم شود</span><span lang="FA">.</span> <strong><span dir="RTL" lang="FA">نتیجه</span><span dir="RTL" lang="FA">­:</span></strong><span dir="RTL" lang="FA"> </span><span dir="RTL" lang="AR-SA">رفع مشکلات عمده در عرصه تولید محتوا مبتنی­بر مسؤولیت پذیری دیجیتالی می‌تواند قواعدی برای دولت ایجاد کند که با هر بهانه و تهدیدی از سوی تولیدکنندگان محتوای نامطلوب و خلاف خواست عمومی، حق بر اینترنت و فضای مجازی را از مردم سلب نکند. از این</span><span dir="RTL" lang="AR-SA">­</span><span dir="RTL" lang="AR-SA">رو پیروی از حاکمیت قانون و منع تصمیمات خودسرانه درزمینه</span><span dir="RTL" lang="AR-SA">­ی</span><span dir="RTL" lang="AR-SA"> تولید محتوا نیازمند ملاحظه حقوق اقتصادی و اجتماعی مردم در فضای مجازی است</span><span dir="RTL" lang="FA">.</span> https://www.jhsrj.ir/article_738087_04a71b3ae6a241c6907d57818addbe59.pdf
