Background and Aim: With the expansion of emerging threats in the field of global health, the relationship between health security, human rights, and criminal law has gained increasing importance. Focusing on the intentional transmission of Communicable Diseases, with Particular Emphasis on the HIV Virus, this article seeks to examine the extent to which the criminalization of such conduct can be justified within the framework of health terrorism and how it can be aligned with fundamental principles of human rights.
Materials and Methods: The present study was conducted using a descriptive-analytical method with a comparative approach. In this regard, the theoretical foundations of health security, the right to health, the criminalization of HIV transmission, and examples of legal developments in different legal systems were analyzed.
Ethical Considerations: In analyzing the subject, principles such as human dignity, non-discrimination against people living with HIV, protection of privacy, proportionality in criminal intervention, the principle of legality of crimes and punishments, and the need to safeguard the right to health were taken into consideration.
Findings: The findings of the study indicate that modern legal approaches have moved away from broad, fear-based criminalization and instead emphasize criteria such as criminal intent, actual risk, causation, and proportionality. Moreover, in contemporary criminal policy, HIV transmission is not equated with classical bioterrorism, except in extreme cases involving an intent to cause widespread harm.
Conclusion: The criminalization of intentional HIV transmission is justifiable and legitimate only when it is narrowly designed, based on the establishment of intent, the existence of actual risk, and compliance with human rights principles. Otherwise, such an approach may lead to discrimination, violation of privacy, reduced trust in the health system, and weakened effectiveness of preventive policies.
